Legal Basis
The tax relief we help you claim is enshrined in UK law
The additional pension tax relief that higher-rate taxpayers can claim is established under Section 192 of the Finance Act 2004. This legislation provides that individuals who pay income tax at rates higher than the basic rate (20%) are entitled to claim relief on their pension contributions at their marginal rate.
How Relief at Source Works
When you contribute to a Relief at Source pension scheme, your provider claims basic rate relief (20%) directly from HMRC and adds it to your pension pot. However, if you pay tax at 40% or 45%, you must claim the additional relief yourself.
HMRC does not automatically apply this relief - it is the taxpayer's responsibility to claim it through Self Assessment or by writing to HMRC directly. Our service helps you do exactly that.
Under the Taxes Management Act 1970, taxpayers can claim overpaid tax for up to four years after the end of the relevant tax year. This is why we help you claim for the current year plus the previous four completed tax years.
